Two question for you John. One, is there any other Lottery case pending and second, What ever happened to the employees who began all her troubles. The Lottery question is up for grabs but what about the second?

Its about time the IRS stop robbing $ from Americans.

We all have to work. We all pay are taxes for working. If you get a promotion you pay more taxes.
If you win in the lottery, the IRS is always there with their open hands to make your life miserable and to make you stressful to take away your winnings, The amount is so large and humongous dollars of taxes where does the money go. The more money you earn the more you pay IRS.

Hurrah for Murphy. Its about time the IRS get their #$%^ kick. Individuals who become ill and can't work should not be tax.. Therefore the IRS should not tax anyone who is ill, disable, whether it be physical or emotional, depression etc.. If the job is the cause than by all means get what you deserve tax free.

That was sneaky the way you used the word "lottery" in the subject line to get people to read a boring story about something unrelated to the lottery. That seems to be an ever-growing trend on the Internet to get the increased number of "hits" which, in turn, means more advertisers. You guys are
soooooo smart. Making moneydoing nuthin but foolin' people.
Wanna bet whether this comment will be posted?

p.s. Why don't research and answer some real good questions like:

1. Why are federal employees cash awards taxed by the same federal government?

2. Why aren't (government sponsored) lottery tickets tax
deductable?

3. Why do federal employees have to pay ANY federal tax?
The pay scale says one thing but in reality you never get to hold the money.

Your comments seem confused and misguided--as well as unfair and nasty

The article summary would have given anyone a good idea of what the article was about. If you are in too much of a hurry to read a short summary (but have time to write nasty comments), you shouldn't be complaining so much. It was clearly about a tax issue for payment from a national guard unit and that was the point of the article.

Second, many Americans think we are overpaid and underworked. Those that pay taxes also pay taxes on their bonuses and their salaries. Not taxing federal employees would not be politically unpalatable--especially in view of a recent article on this site that noted we make twice as much as the average American.

In short, your comments make us all look bad. We are not all whining bureaucrats who are unable to read a quick summary of a free article before we start complaining. And, by the way, I don't mind paying a fair share of taxes for the benefits we have of living in a great country

Great job! It's about time the IRS was reigned in on taking money from federal employees and the American public in general. Maybe now the 'common' person will be able to live in this great country.

Nobody mentions the fact that prior to 1996, mental damages were excluded from income. But in 1996, in order to provide tax benefits for the wealthy, Congress claimed the tax loss would be offset by taxing those who suffered mental problems. Their propaganda did not address the fact that out of court settlements would be less likely, thereby increasing not only the costs to the plaintiffs and defendants but also to the courts. Originally the entire 1996 act (139 items) was rejected by the Senate. But finally because there was an increase in minimun wage involved, it passed. Even Clinton went along while specifically criticizing the change in taxing mental "awards". Indeed, aiming at those least able to defend themselves has been a policy of conservatives. It was the aim of the Reagan administration in secretly denying those with mental problems certain benefits see BOWEN case, 476 U.S. 457 (1986). Even Giuliani (then U.S. Attorney) refused to represent the government. In the early 1900's there was a secret policy to initially deny SS disability benefits to the mentally disabled. And then we had this 1996 "blackmail" legislation also harming the "non-physically" but mentally damaged.

To those who are critical of this MURPHY decision, I simply say, "wake up because even conservatives (the two Republican judges) realize that not only the wealthy must be considered, but also those "less-blessed" should not be "damaged" in order to BENEFIT the wealthy. Damn political contributions, otherwise known as "bribery"!

My wife, who has recently retired from the Missouri Army National Guard after 35 year of competitive civil service, is in the same proverbial boat. She won an EEO case and was awarded 87K. Last year we received a tax bill from the IRS for over 36K. We have been fighting this and this case law is a God-send! Thank you FedSmith!

For those who do not or have not worked in the National Guard, it seems that they have an overwhelming number of EEO cases because of their attitude that they do not fall under any civil service law.

This case will be a great victory for those individuals who were treated as if they were something less than a human being!
