Could an injured third party hold a referring party liable for refraining from sharing information when withholding of such information is in compliance with a mediated agreement? Some mediated agreements that come about in the workplace result in standard references. Such standard references include only name, dates of employment, job title, and the like, with specific prohibition to sharing any further information with prospective employers.
