13 Years and Still Filing Appeals to Recover a Lost Federal Job

Let the petitioner file as many appeals as he wishes. That's his right. As civil servants, we have a duty to serve him. If we don't want to do the job, get another one.

The Civil Service serves the taxpayers, not individual civil servants. While I am all in favor of due process and protecting employee rights, at some point "use of the process" becomes "abuse of the process." Litigation is very expensive for both parties. The government's costs are paid for with tax dollars. Do you really want your tax dollars being spent defending against endless appeals, even if they are clearly frivolous? I can think of better ways to spend those dollars.

If the petitioner is allowed to file as many appeals as he wishes, who is required to pay for the Govt. repeatedly having to defend it's decision?

People do not fight like this if they are in the wrong. He is also a taxpayer lest we forget. We serve all taxpayers not just the ones we like.

I've been a labor and employment attorney with DoD for almost 15 years. Trust me, some employees fight VERY hard even if they are wrong. I know because I've sat across the table from them in court. Their hurt feelings, frustration and pride prevent them from looking at the situation objectively.

If owcp discontinued benefits i hope that he applied for opm disability retirement. If he wants to work and is tenacious about it why are you gadflys questioning this. He may need to support himself. The P.O. is notorious for treating injured workers harshly.

Attorney, I do not disagree with you. I fired someone at my part-time job last night. It took all of 20 minutes. It was refreshing to say the least. The idea however that someone cannot have a valid issue is suspect. I just want to be fair. Is the Government more than fair sometimes and the person is often prideful and misses the boat when it's time to get off the roof? Yes.

This case highlights a problem with the federal appeal system - there is no way to stop nuisance appeals and, while it can be done, courts are not willing to make persons filing these appeals pay the agency's cost for defending itself. I would guest that the cost to the Postal Service is well into the six figure area. As for the person filing the appeal, he probably has a deal with his lawyer that the lawyer does not get paid unless the case is won.
