A Bad Combination: Machine Guns and Lying to a Grand Jury

Only in America! Where else can gang bangers and convicted felons walk the streets, and police have to fight tooth and nail to get a conviction, only to be overturned with some minor infraction of a rule or regulation. Then we get to hear of a person headed for a 33 month sentence that is in ill health, worked for law enforcement, and presumably been an upstanding citizen for his whole life. Somehow I don't think the BATF or our justice system was set up for this kind of crap. I guess that the Crypts, Bloods, and Mexican mafia must carry all of the correct permits needed to go and wantonly shoot people and possess all the weapons they need to carry on their business, but someone who is a common citizen can spend 33 months in jail. Must make sense to someone! WOW!

This has nothing to do with gang bangers, convicted felons, etc. He made the decision to lie to the Grand Jury and he has to live with the consequences - "common citizen" or not. Who knows - maybe he'll be paroled or get time off for good behavior.

hundreds of people purchased these parts kits. in many parts of the country. many if not most received no prosecution, nevermind a penalty. as he returned the kit - he should have just left it there and stated as such to the agents.

This case should NEVER have been prosecuted. The BATFE was investigating a company who LEGALLY imported DE-MILITARIZED junk guns from Russia (torch cut into many pieces, per BATFE rules). MILLIONS of de-milled machine gun parts/kits have been imported to the USA over the years. It's difficult to make an operational gun out of any de-milled gun. The BATFE obviously had it in for the importer and those who bought this junk.

This guy LEGALLY purchased the parts kits and had not attempted to re-assemble it into a workable firearm. He sent the original kit BACK to the purchase point, per BATFE instructions. The company then sent a replacement kit back that was "in compliance".

He was called to testify during the investigation. Who knows why he lied under oath? But apparently he didn't have the same lawyer as Bill Clinton, Karl Rove, Dick Chaney, and a host of Govt. perjurers.

Rule # 1 when called to testify for the Feds: don't lie by pleading the Fifth Amendment. Sad but true.
