The last perfect person was hung on a cross!!! I am sure that there is more to this story than a supervisor weighing all the Douglas factors and then deciding to fire this person. If this is a one time offense he should have been given a second chance after theraphy or proof of educating himself by a "12 step" program. Some of the responses to this problem shows that there are a lot of narrow minds in the government who should find more information on use and addiction before such a harsh punishment is rendered.

This is a good decision by the court. Public safety employees (law enforcement, fire and rescue) perform critical services for the public and the government that require clear thinking and sound judgment. An imparied mind puts the safety of the public at risk--both the parties being served by public safety employees, and the government as a whole when negligent conduct or performance occurs.
An employee who has been adequately warned that illegal drug use was not tolerated as a condition of employment should be terminated if he or she is caught using illegal drugs. There should be no second chances for employees working in these positons as impaired judgement can lead to injury or death rather quickly.
