None of what is outlined in the article is required. A manager can simply make up a story, have an amoral associate corroborate it and have a corrupt HR division write it up. This has happened to me and to others at HUD.
The comments about OCD are ignorant, discriminatory and offensive. OCD is an extremely painful illness. Many of those afflicted go years in silent suffering because they too ashamed to tell anyone what they are experiencing.
The statement: "If OCD will get an average person committed.." is a disgrace. OCD has destroyed many lives. It has cost sufferers careers, marriages and the enjoyment of life. The majority of sufferers also suffer from depression. Most, however, are not "committed". This term itself is insulting.
Most of those unfortunate enough to be afflicted with this devastating illness can be treated once it has been diagnosed, which, on average, takes ten or more years after onset.
Would you make light of cancer or Parkinson's disease?

Is FedSmith helping to get federal employees fired by some of these articiles. I think we need something different - don't know what but something different.
I don't see any team of individuals helping/trying to resolve the problems or come to some type of resolution for these problems (and a lot of these problems keep re-occuring).
EEO works for HRO and management and does not resolute the problems (they protect bad supervision).
The employee is alone thru out this process.
Understand that when a problem reaches this level -
it has now become very personal......
Everyone in government knows this.
People will take sides!
Some people will take sides with promises of promotions to those that side with the supervisor/management (I have seen this six times in my career).
I think we need sometype of training, or union that can resolve the problems - you don't gain anything by fireing an individual because now the government wants to element that billet

You've spent an quite a bit of time advising the federal manager of Disciplinary Actions, have you ever thought about providing advice to the recipient? There are some pretty outlandish disciplinary actions proposed everyday in the federal government. Unfortunately, most federal employees in receipt of a proposed disciplinary action knows what to do first or where to get help.

Sounds to me like these are some good instructions on what things to destroy and what not to destroy so when it comes to appeals time, any records that may show the whole thing is a setup would be destroyed.
My opinion is that after reading this article, I certainly wont be hiring a consultant for these types of actions, unless I've decided to take part in a cover up.

Mr. Gilson: Considering your "Rule#3 - It is usually discoverable" and the information in this article about the left side of the file belonging to the specialist, is it prudent to even keep "working documents" in the file at all? Do you know of any case law where the "working documents" were ordered released during discovery (perhaps the specialist did not destroy them well enough :) ) ? I enjoyed your article and am looking forward to your response.
