Great Article. Cabaniss, like many other appointees from this administration, has done lots of damage and it will take years, if ever, to get past the bitter feelings. We work for the most powerful employer in the world - they have more $ and more lawyers. It is only the law that levels the field but when the law is ignored and the administration gets away with it, citizens suffer.

"Like all agencies, sometimes they possess poor leadership at one time or the other. We all have seen similar circumstances in most agencies. Therefore, the public need not look to our Federal agencies for leadership in things like energy for example. Why? Because government is risk averse the public needs to look elsewhere. Mismanagement tends to cripple any forward movement and when energy is involved we cannot just stand by. Thereby, the public needs to actively pursure ways to ensure that he U.S. has an ample supply of energy. It's a 30 to 40 year endeavor and should we as a nation get misguided by political appointments, the boat may get scuttled and sink.

So, does this say more about the FLRA, or about our defenders of clear logic and unbiased reasoning - the courts?

Instead of sinking the hull, providing new leadership and a new crew might do the job. That would enable retention of that whcih works and avoid protracted legislative battles at a time when a host of similar problems exist elsewhere in government.
Voters will send a thank you card to the GOP by keeping it out of office for a generation or more.

I say just hang in there for a new administration so a new head can be named. we all know the gross failings of the present administration. but don't throw the baby out with the bath. just draw a new tub of water when the time is right.

Great Job Frank. This was a thoughtful, balanced and well written article. You have really pulled together alot of the facts and themes that many of us have been reflecting upon.
Bravo for the facts and the themes.

I have two daughters in college and they continue to identify professors that are ordained politically and demands that students see it their way or they will fail...That's too bad, so much for challenging students to think....
Fortunately, the law is the law and it is defined. Normally...Obviously Mr. Ferris has been around for some time, but I am of the belief that he has a limited perspective on the role of the FLRA. When NSPS and DHS were goint to create their own boards, he was against it?
I believe labor unions themselves overload the FLRA with nonsense, incorrect appeals and bravado. During my 27 years on both sides of the table, I find that labor is self inflicting it's own demise. Blaming that demise on the FLRA or the Bush Administration won't improve labor's bill of health. Labor needs to self reflect upon itself and determine its role.
