"Last Chance" Agreement Means What It Says

In my last HR Specialist position, I reviewed their previous Last Chance Agreements and started laughing out loud. All of their Agreements stated that the employee was to go to Alcoholics Anonymous (AA) and meet all the requirements of that program. The funny part is that Tradition Three of the AA Program states, "The only requirement for A.A. membership is a desire to stop drinking." You don't even need to have an honest desire, or even stop drinking to be meet the requirements of AA.

Needless to say, the Last Chance Agreements that I drafted were much more detailed. First, they included a requirement that the employee not use alcohol or any drugs other than as prescribed. I also included active involvement in AA, Rational Recovery, or other recognized long term treatment program and gave a general description of what active involvement entailed. I think I had a better success rate with my LC Agreements than they had previously.

Years ago when Chief Steward for the UBC representing employees at PSNS I was involved with a Last Chance Agreement case. As I was already representing the employee, the employer violated labor law by meeting with the employee with no representative present(I was on leave.).
Being part of the Bremerton Metal Trades Council, I filed a Council grievance. Upon meeting with the employer I showed them in Federal Law where Last Chance Agreements are negotiable. Alas, even though they admitted I was right, the Metal Trades Council refused to pursue the matter further.
Consequently, the employee was later removed for violation of the Last Chance Agreement. These agreements are so heavily weighted in favor of the employer that employees have a minimal chance of getting through them without violation. Were these agreements negotiated the employee would have a better chance of getting thru the probation.

I've found last chance agreements to be a very useful tool in some cases, particularly when there's a reasonable chance that the employee can be rehabilitated. When they're done properly, the Board and the courts will support you, and the employee gets one last chance to straighten up. That's about as close as you'll get to a win-win situation under the circumstances.

I have found these very useful with a very good results in most cases for the employees. I have to disagree with the person from Pugent Sound Naval. The LCA is weighted in favor of the employee who wants to be successful. If the follow the basis rules that every other federal employee must follow they will be sucessful.

While working as a Letter Carrier we ran into a similar incident. A femal carrier had a bad habit of not showing up to work and not calling in. The next day she would come in and say she had been sick. Too sick to pick up a phone? She also had a separate incident of being AWOL for 3 months.

Management was in a corner and decided to give her a Last Chance Agreement. Several months went by and she was a model employee. But, alas, she didn't show up one day and failed to call in. Her termination was fairly swift at that point since she have violated the terms of her LCA.

AWOL for 3 months? And management did not notice or did not do anything about it? Talk about incompetence.

the last chance the employee has.

When confronted with the weight of the last chance agreement, employees and their representatives often balk at the seemingly tough stipulations placed in the agreement. In actuality, these stipulations are merely a written version telling the recalcitrant employee what to do in order to be successful. Those that challenge this never seem to make the connection that roughly 99 percent of the rest of the employees do these things without being told.

The other amazing thing some employees and representatives do not seem to register it the title, "LAST CHANCE". This speaks volumes to most readers. The first two words tell one that this is it, over, finished, done. You have stretched the limits and you have no more room. You are hanging onto the bottom side of the knot on the end of the rope. Your antics are no longer welcome. They take it or suffer the consequences of the original action. If taken, then do it.

sadly for ms. fiori she decided to gamble her job yet another time. i think her termination was well-deserved.

While it might be sad that Ms. Fiori lost her job, maybe this will represent what people in Alcoholics Anonymous call, "Hitting Her Bottom." Hopefully, this will be a big enough shock to her that she will stop drinking/drugging and it might save her life.
