Oh come on! How can an agency be held to a disability claim on information not available to them (and should NOT be available to them!)

BUT, this person should not have been denied her medical clearance in the first place. The agency should hire her, but based on her clean bill of health, not some trumped up disability claim. Stuff like this makes it so much harder for bona fide claims to be taken seriously!

What about me? I don't get as many opportunities as I would like, therefore I am frustrated part of the time. Who do I sue to be made whole in this matter?

How is the agency involved in the "disability" determination? Aren't those made by Social Security or Workers' Compensation based on medical information?

The FS discrimated against her because of her cured or "cancer-free" medical condition. Just how much less logical is her claim they were "discriminating against her because it regarded her as disabled due to her cancer diagnosis"? Under the law she has to show she is an "individual with a disability" as someone with an "impairment" that "substantially limits" a "major life function" or "is regarded as having such an impairment." She is only showing it now because they forced her to show it to them. The illogical nonsense of the FS caused her to disclose information they now say is none of there business and she is trying to hold them responsible. Since when does the disability have to have an impact on the individuals ability to do the job? It doesn't! Justice LeCraft is trying to blame the victim.

How can an inpairment like Ms. Adams' impairment can affect this dopey agency. Just because she has this health issue it has nothing to do with her work performance. Ms. Adams' stay encouraged and go seek help from the ADA that is the reason why former President George H.W. Bush signed it into law because he knew this was happening.
