The only casue for comment is what took the court two years to figure out - after getting suits filed against the Declaration, etc., - that they were dealing with someone who was missing more than a few nerons upstairs.

Mr. Hurt's "absurd and frivolous claims" are no longer "a form of costless entertainment": they are now a form of low cost entertainment. Filing fees are low, and do not even come near to covering the actual cost to the court...let alone to the defendents in such suits.

More needs to be done with frivolous complaints and frequent filers. EEO offices can't focus on issues and prevention due to such employees (& others.) The EEO system is just too easy to use with no consequences for the filers - no cost for the expensive & time-consuming administrative process, no consequences for unfounded truths, and no consequences for breaking confidentiality of the process. Anything & Everything comes through the process; all an employee has to say is "EEO" - even when they admit it's not EEO, but want to file anyway. My Department accepts everything - untimely, refiling on adjudicated issues, & more. Settlements? They come back more frequently for more. The poor employees who actually may have been harmed are lost in this mess of a process. They either don't file because of the negative stigma due to the losers, or may not get justice because managers & agencies are frustrated.

Your points may be valid but the DC Circuit Court isn't an EEO office and this poor guy isn't filing EEO complaints. I don't know why it took so long for them to shut him off.

The person filing the friviolous claims obviously has too much time on his hands and isn't too concerned with making his position in life better than it now is. And, he obviously doesn't recognize the old saying...'recognize those things that you can change and have the wisdom to recognize those you can't change."

We need this same judge ruling on CS EEO cases and MSPS as well 90% are based on "hurt feelings" time to end this nonsense

Apparently truth is irrelevant. The Budget Analyst does not dispute the accuracy of the Diversity Manager's statements: only attacks him/her for making them. (At least we can be grateful that our Budget Analyst did not waiste our time by denying the obvious.)

Perhaps a Diversity Manager somehow wouldn't notice the abuses in the system? I'd say any Diversity Manager would have a ring-side seat to view the abuses. Perhaps ideology is supposed to silence him/her? Apparently so.

I did come on a bit strong, but are you aware that 95% of statistics that are published in the news media are made up. If you don't belive me, I just made that statistic up. Even Wikiopedia required sources or citations for statistics. My understanding of the published material is that a predominance of cases that go before the MSPB, the employee prevails.

Budget Analyst, I think you're wrong about the MSPB statistic. It's the other way around; the Agency prevails in the majority of cases--which is a shame. They should prevail in all.

I am curious about a few things.

1.) What is the source of the 90%. The same as my 95%....
2.) Does Wikiopedia require sources? At least legitimate ones.
3.) MSPB stats are avalible on a number of websites, what is the source of the most of the cases are hurt feelings....

As far as the NSPS, the only way you would be rating me is if you are in fact a political appointee at the Under Secratary Level which I doubt. If you are, you won't be here in a few months.

budget Clerk both agencies publish annual reports that provide all the statistics # filed adjucated and decision. In order to read them you have to put your finger under each line and read across its a simple exercise that I'm sure you can do. its in line with your normal clerk duties and you won't have to file an EEO for someone to read you the data

The sites I have visited do not state if the case was settled in favor of the agency or individual. You have to read each case posted. Can you site the web site that gives this.

I am only guessing that you are an appointee because it is typical when you try to inject facts and sources with appointees, you get petty insults and nebulous emotional statements.
