MSPB Endorses Alternative Discipline, Encourages Training for Managers and Practitioners

MSPB, needs to be disbanded, instead of helping veterans they have turned into an agency lapdog, and are clueless in ADA and Rehab Act Laws.

I was wondering what is the definition of Alternative Discipline and when I clicked the OPM's link what I found was the specifics of ADR. Is this the same ? I thouhgt it was a different concept. Please advise

Alternative dispute resolution is when there is a conflict between two people (often a supervisor and an employee), and there is an attempt to help them resolve the conflict. The conflict does not have to be behavior for which someone could be disciplined. And for ADR, the supervisor could be the one in the wrong just as much as—or more than—the employee

Alternative discipline takes place after a determination has been made that an employee has done something for which discipline is appropriate. But, rather than take the disciplinary action (reprimand, suspension, or removal), the agency offers a different way of helping the employee to see the error of his or her ways.

In short, the big difference is that ADR is for any conflict that arises from humans interacting, and Alt. Disc. is for when there is a defined event for which corrective action is appropriate, but the agency uses something less traditional to get the employee’s attention.

Has anyone done a study on whether or not these programs work? Are they any more effective than just firing or suspending the bums and letting God sort it out?

I have worked many years in employee relations and find no value in holding suspension actions in abeyance for significant periods of time. Supervisors move on to new jobs, HR specialists go elsewhere, and employees themselves change jobs. To continue to track an employee's conduct back to an original abeyance agreement over months and years can easily become unmanageable. I strongly recommend a supervisor reach a final decision in the here and now instead of extending oversight to a preliminary decision over months and years.

I just wish that managers understood what they agreed to and stuck to their bargains. A good friend of mine was going to be suspended for 14 days. The manager agreed to hold this in abeyance because my friend was going into a 28-day rehab. The week after my friend got out, his supervisor effectuated the suspension. This is not the meaning of holding an action in abeyance! My friend used this as an excuse to start drinking again.
Unfortunately, the union screwed up his case. So my friend was forced to take retirement, even though he loved his job. We recently buried my friend, who died of his disease of alcoholism. I just hope that his former supervisor has the decency of having a guilty conscience, for using discipline as punishment rather than a way to correct behavior. Instead of trying to give a sick person the support to try to recover from the deadly disease of addiction; the supervisor just wanted penalize my friend for what the supervisor saw as his moral failings.

How about fixing the lousy care that veterans get first. The VA already babies their employees to the detriment of the VETS.
If you want alternatives let the vets receiving care decide, it will open your eyes

What does Alternative Discipline of employees have to do with VA's role in treatment of veterans? Two entirely separate issues. Looks like the Diversity Manager has had some loco-weed snuck into his feed again...

You may find it helpful to read the report this article is based upon. If you go to www.mspb.gov and click on MSPB STUDIES, it will take you to a page with all the Board’s most recent reports. The one on alternative discipline is listed first. The report itself contains a description of alternative discipline, some examples you can consider using, and a section on what you may want your agreements to contain in order to ensure they are enforceable.

You can also sign up for the listserv on the studies page, to receive notifications when future studies are released.

As long as Mnagement has unlimited funds paying for unlimited lawyers, we gov employees will be very limited on the discipline favoring us, alternative, traditional or otherwise!
