I agree with you...but to be honest, how many times can you count where someone said "I am going to kill so-and-so?" It doesn't mean they are actually going to do it. What we have here is a belligierent person who always started something and management finally got tired of it. He was his own worst enemy.

While violence or even the threats of violence should never be tolerated, I wonder if Morgan was provoked by repeated incidents of retaliation? Prolonged exposure to a hostile work environment can harm anyone and I hope he will seek some ongoing therapy to heal from this unfortunate situation.

There is no evidence in this decision that the employee endured a hostile work environment, nor does he claim to have suffered one. In my opinion, the individual most in need of counseling (and perhaps a bodyguard!) is the supervisor who this now-fired employee threatened to kill.

He should have known better...

It doesn't matter how many times the employee feels that he is being retaliated against, he should have known better than to threat to kill someone. You don't have to be a rocket scientist to know that any threat cannot be tolerated in Federal Government.

The MSPB, the Administrative Law Judge, and the Agency did the right thing.

I've gone through the whistleblower process and can sympathize with Morgan. It's unbelievably stressful and wears you down after 2-3 years. Managers will bait you trying to discredit or get you fired. One really needs nerves of steel to get through it. Yet, Morgan crossed the line by threatening to kill his supervisor. I had a coworker threaten to kill me for being a whistleblower, yet the agency did nothing. Going to work each day worrying about being killed is not something I'd wish on anyone. People who make threats, like Morgan, have no place in the federal workforce. There needs to be zero tolerance regardless of who makes the threats.

The scary part of this story is that there are similar circumstances in other agencies that have resulted in management directed reassignments of the offender's supervisor rather than dealing with the egregious behavior. I am very happy to be retired from this almost totally dysfunctional organization.
