Changes to the Americans With Disabilities Act and The Impact on Federal Agencies

I am wondering how this will impact the determination of a disability by a Federal Employee's Health Care Benefit provider.

Interesting how their definations of disabilities are never changed by changes in the law.

Also interesting how many buildings are not currently accessable to personnel with disabilities. My current position is on a military post, and there are no provisions for evacuation of disabled personnel in an emergency. Just as there is no way for me to enter the building when I have to come in after hours (no automatic doors). The last building evacuation, I had to leave my power wheelchair behind and be carried out by firemen.

Not good, but typical of the buildings on my post.

A few years ago I spent six weeks in a wheelchair. It was an enlightening experience. A little thing like a porch step can suddenly become a nearly impassable barrier, and if you're in a wheelchair you're invisible. People cut in front of you; you know they'd say "excuse me" to someone who was able to walk, because you hear them doing so, but when you're in that wheelchair they just don't see you.

Anything that makes the lives of the disabled less complicated has my approval.

When I was in college (Early 1980s), the Dean was asked to spend a week a week in a wheel chair. He lasted 2 days; however, he became more sympathetic to the disabled. Walk a mile in someone else’s shoes (or wheelchair) to understand them. Reminds me of the old saying:

What do you call a law and order conservative; a liberal that has been mugged.
What do you call a civil libertarian; a conservative under indictment.

This information is wonderful to have. So many "disabled" people have been further discriminated against on the job. This information clarifies a lot for me and I will pass it on.

Of course someone or group will push the limits an be back to the court. Common sense never seems to qualify reasoning hence so much time spent in court

Well the bad new disableds are being discriminated at any federal/government agencies. There are no good luck to them at all. Disableds are being push over the other side of the track. That is very sad.

Because I don't (yet) live in a chair, and most times the woman in charge of parking assignments doesn't see the difficulty I have moving by the end of the day, I was left off a parking space assignment. She said she notified the "handicapped" to contact her for an assignment. Turns out she didn't think I was "handicapped" so didn't send me the notice. My medical paperwork was in her files but I didn't "look handicapped." I had to go up to the commanding officer before I got a barely useable space. In the course of time I went to a different location. They got my request and enthusiastically hauled out a can of traffic blue and made TWO spaces as they previously had none. In the course of time I was dragged back to the old location. I told the woman that I was coming back and would need a space. She said she would do nothing until I was already there...she then reassigned spaces during the month before I came back and left me out. I wish she would just do the simple stuff.

Do you have a handicap tag if so they should be spots to accommodate you. Unfortunately I've worked with people claiming that status and demanding a better spot. DOD regulations are quite specific there are "NO" designated parking spots other than handicap and generals. Any other you see are BS and I park in them all the time

What is the acronym EEOC? It also might be illuminating to provide one sentence about the relationship of the EEOC (whatever that is) to the ADA.

Are you serious? EEOC is Equal Employment Opportunity Commission. ADA is American Disability Act. The EEOC enforces laws such as : Title VII of the Civil Rights Act, Equal Pay Act, Age Discrimination in Employment Act, and Title I and V of the American with Disabilities Act.

That is the relationship between the two.

I am a veteran and I was a Customs officer. I was nearly killed on the job and left visually impaired. I lost my career, ability to drive, my house (not close enough to public transport) and I am alone in a fight to get a decent job. DHS was created just after I was injured. When I could live on my own again, I was demoted to a menial job (it took my union to get me that) and I started searching for a position appropriate to my ten years of service. I found the perfect job and it's with ICE. I pursued the Disability Hiring authority. I did all the bureaucratic acrobatics and followed all of OPM's instructions which led me to the Special Program Placement Coordinator for ICE. We spoke, I provided all the paperwork, I called back and emailed and she kept telling me to be patient with the process. In the end I learn my resume went nowhere, Affirmative Employment is on the ICE website but it is all smoke and mirrors. It doesn't exist.
