This is a great article. I'm in the waiting stage now. I questioned fraud in my office in Nov 2006. Within two weeks, my outstanding performance ratings were suddenly reduced to poor performance. After being exposed to bullying, threats and hostility in 2007, I was forced to take medical leave in 2008. Marshal and Chief threatened that if I returned to work, they would build case against me. I was forced to file for disability retirement in August of 2008 after 29 yrs of federal service. Agency would not even address the fraud in our office. My attorney finally got the application forms to my agency Dec 2008. Agency forwarded NFC and finally OPM recd Feb 2009. In the meantime, without an income, I filed for discontinued service retirement. OPM stopped the work on the disability retirement case and put everything together to work the discontinued retirement. I understand the determination could be another 6-8 months. How do they expect employee to survice?

I've been impressed by your reasoning and writing skills before, Mr. McGill, but I think this article stands out as a work of art. Your premise development and elaboration leading to a list of common principles was downright elegant. While researching the 'benefit' of disability retirement for my own use, I'm quickly developing an appreciation for the delicacy of assembling that "preponderant evidence" and then following-through as required. My professional career has engaged me in similar work and I should be able to do all this myself. But as you noted, when I factor-in the reality of the disability driving me to seek this “end”, it’s becoming obvious to me that the straightest line from here to there may require the assistance of an experienced and eloquent attorney.

i fought the us postal service for 16 years i was hurt on the job, no income, put on leave without pay. i finally received my disability retirement, but i think im owed payment for the years i was in a lwop status, but i know i will never het it. so ill keep what i got.

all the time i was fighting for my disability retirement i was put in a lwop status. i think i should be paid all the money i lost in this status. but the government gets you any way it can.

since I dont really know how to apply for disability can someone esp. disability atty. I was diagnosed with anxiety and panic attack in 2004. Still seeing pschy & on meds. xanax, prosac daily 2x. Want to get better and live a normal life w/o taking meds. But when I don't take meds. lots of weird things happens to me, disoriented, don't remember things etc, not feeling normal. I want to apply for disability...HELP... AM I QUALIFIED???

Laws are written and are interpreted by those affected, and works to their favor. So therefore, the following is not true that:
"The law is never something to manipulate; it is, rather, a compendium of principles upon which a society relies. Moreover, they are principles which are applied, as opposed to being manipulated, to serve an end."
Laws are forever manipulated to serve the one challenging it.
