I agree that Hernandez broke the law and her punishment was appropriate; however, I also want to point out that this is another example of Obama's double standard policy. While Ms. Hernandez's mother is in this Country illegally, the article doesn't state if the Mother was sent back to Mexico which I doubt. So, we have one more illegal alien mouching off the citizens of the United States while the citizen is fired! GO FIGURE! Since Obama got into office, I can't retire after 30 years of Government Service and I have to pay for the Federal Government breaking their own law. I really am very tired of this entire Administration.

This case was being tried long before the current administration; just as the current financial crisis was here BEFORE the current administration! The country will never work it's way out of this mess if we continue to fight against each other. Let's focus on the positive and work together.

Having worked with MSPB cases for over a decade, I can assure you that this employee's misconduct occured well before Obama became president. But some how it's his fault? Following your thought process, it should be Bush's fault. (I might blame Bush for many things, but not this!)

If she is trying to get her citizenship she is already a legal permannet resident. Therefore, you can not deport her.

You can not retire due to your own lifestyle choices. Don't blame anyone for your bad choices in life. It's not Obama's, Bush's, Clinton's or any administration personnel. This was clearly bad choices on your part. Obama has only been in office for a 100+ plus few days. How has anything he done affected you personally. I work for the gov for 27 years and my retirement has not been changed at all! Give me a break!

Isn't the greater good to get citizenship status? This administration should have no trouble finding a good supreme court justice that believes so. Especially with the stellar cabinet who finds tax shortcuts.

I find this statement by the court interesting...

The appeals court also pointed to Hernandez's refusal to admit to wrongdoing and her lack of regret for her actions as properly factoring into the removal penalty.

So is saying I was wrong and I'm sorry a route to a less severe discipline?

Yes and No. It won't automatically reduce your penatly. But thanks to Douglas v. VA there are 12 factors that can mitigate or aggravate a disciplinary situation which must be considered before deciding upon a penalty. Failure to admit you've done something wrong and failure to express regret are two things that play a part in determining your "potential for rehabilitation", which is one of the 12 Douglas Factors.
