This clause is troublesome: "...except that these days will not be counted in determining average pay or annuity eligibility under this subchapter."
If it is counted toward annuity, but NOT counted as "average pay", how is it applied in the final annuity formula?
How do you know it has been applied?

Everyone needs to take a breather on this. The normal course of business after changes are made into law usually will starts with OPM promulating procedures and processes to agencies on how to process the XYZ changes. Your individual agencies will then put out procedures on how to accomplish this, with governing guidance on effective dates, etc., etc., etc. Everyone will get whatever they are entitled to under the law.

The problem with stating that a number of the new authorities are available to agencies "immediately" is that while the law may say they are effective upon being signed by the President, in reality until OPM issues implementing regulations establishing specific procedures and a regulatory framework, agencies really can't proceed "immediately." When OPM eventually comes out with such guidance, it will no doubt be retroactive to the date the law was actually signed, but effectively agencies as of RIGHT NOW have their hands tied until such OPM guidance actually is published. This will most probably be in the form of interim regulations promulgated in the Federal Register, as there's not time for the usual cycle of first issuing proposed regs for comment following months (or years in some cases) later by the issuance of final regs. So now we all wait for OPM action.

I hate the term "bureaucrat" but it applies in this case.
Mr. Berry can leave his fingerprint on HR by empowering agencies to create interim regulations when laws are issued and then finalize them AFTER OPM issues theirs so they are consistent with OPM regs.
Now that's a NOVEL idea, empowering frontline HR offices
Please explain this to me!

Fourth, a change of the ending date for periods of service under CSRS that can be redeposited by actuarial reduction (instead of for separations prior to October 1, 1990 it will be for separations prior to March 1, 1991) is effective immediately.

I am covered by FERS. I will definitely retire 31Dec1010 which means that I will have completed 1/3 of the required phase in period.
Will I get 1/3 of the benefit since I only stay for 1 yr after the implementation of the cola phase out - locality phase in period? I was wondering if I have to stay the entire 3 yrs to be entitled the benefit.
By the way, I am a Federal employee working here in Hawaii.
