Yes, NSPS could have been accomodated by altering the existing labor relations law, but NSPS wanted much more than that.
To put it briefly they wanted the ability to rewrite the law on a daily basis or whenever it suited their purpose through the use of implementing issuances which would cancel any previous agreements and replace any previous implementing issuance.
Implementing Issuances were a blank check to be used when needed.
Two federal judges have said that such a practice is illegal, but the agencies still persist.
Little wonder that the employees are concerned.

I find it interesting that DHS funding for their new personnel system has been blocked, while here at DoD spiral 1.1 is in full swing.
DoD has already tainted NSPS in spiral 1.1 by mandating a set performance objectives, instead of the objectives being developed by the employee and supervisor on a one-on-one bases. When we ask questions concerning pay outs and appeals of performance ratings we are told that guidance is still in development.

What if the author was the head of the agency and had the rights as he proposed regarding an emergency? I can sense from the article that everything would be an emergency. The only difference between his proposal and DoD's is that they used National Security as the excuse. Let's face it the author and DoD want power whether they have the right to or not. They can't lead or use persuasion so they need powere to carry the big stick. You bet I am union because of people like the author.

I hate to say this but payout is determined by the person over DOD or whoever and the manager is responsible for the other all the way up the chain to determine who gets the high pay outs. So it is not just up to 1st line manager any more after the switch over to new pay system. Good Luck LERS DOD
