This always happens; an employee tries to give sound advice to a supervisor but it turns around to bite you.
To make matters worst, the Agency does not admit any fault, although most likely the Human Resource Manager, as well as the Administrative Officer of Alaska probably were involved in the soliciting or actual investigation ordered against the employee. The State Director could not have ordered a misconduct investigation without going through the Administrative Division.
These results are not surprising....

Bill Allen was also found guilty of violating Hatch Act from another complaint. A complaint was made in August 2002 and OSC just concluded their investigation. OSC's investigative results stated that "evidence was found to conclude that Mr. Allen violated the Hatch Act when he requested assistance from a subordinate while preparations were being made for the campaign event...however, because Mr. Allen has resigned from federal service, OSC has closed its complaint file in this matter."
Also, Mr. Allen was allowed to retire, not resign. By retiring he was allowed to take certain benefits (still paid for by the tax payer) into retirement.
